Understanding Income Tax (ISR) for Employees in Guatemala

Income Tax (ISR) is one of the most important tax obligations for any employee under a dependency relationship in Guatemala. If you are an employee receiving a fixed monthly salary, your employer likely already makes a monthly withholding. However, understanding where this calculation comes from gives you the power to verify that your finances are in order and better plan your annual budget.

In Guatemala, the applicable regime for dependent workers is regulated by the Tax Update Law (Decree 10-2012 of the Congress of the Republic). Unlike business income, employees enjoy special treatment with specific deductions that can significantly reduce the taxable base upon which the tax is calculated.

Key Concepts You Must Know

Before diving into numbers and formulas, it's essential to familiarize yourself with the technical terms used by the Superintendency of Tax Administration (SAT):

  • •Gross Income: The sum of all ordinary and extraordinary income received from your employer during the fiscal year (salaries, legal bonuses, extra bonuses, commissions, etc.). Note: the Aguinaldo and Bono 14 are exempt up to 100% of your ordinary monthly salary, so they do not enter this calculation.
  • •Net Income: The result of subtracting permitted legal deductions from your Gross Income.
  • •Single Deduction: Guatemalan law grants all employees a general annual deduction of Q48,000.00 without needing to present receipts or vouchers.
  • •VAT Receipt Deduction: You can deduct up to a maximum of additional Q12,000.00 by presenting personal expense invoices backed with your NIT (up to 10% of Q120,000 spent).
  • •Taxable Base: The final amount to which the tax rate will be applied.

Steps to Calculate Your Annual ISR

The calculation of ISR for employees is projected at the beginning of each fiscal year (or when you start a new job) and adjusted in December. Follow these steps to make your own calculation:

# Step 1: Project your annual income

Multiply your ordinary monthly salary by 12. Then, add any fixed extra income you receive (bonuses, estimated commissions). Remember to exclude Bono 14 and Aguinaldo up to the exempt limit.

# Step 2: Apply legal deductions

From your projected Gross Income, subtract:

  • •The single deduction of Q48,000.00.
  • •Your projected IGSS contributions (labor IGSS: 4.83% of your ordinary annual salary).
  • •The VAT invoice deduction (if you keep track of your invoices, maximum Q12,000).

# Step 3: Determine the corresponding tax rate

Once you have your Taxable Base, the law establishes two brackets:

  • •Up to Q300,000.00: A rate of 5% is applied to the taxable base.
  • •Over Q300,000.00: A fixed rate of Q15,000 plus 7% on the amount exceeding Q300,000.

Practical Calculation Example

Let's imagine Carlos, a professional earning an ordinary salary of Q10,000.00 per month. Here is how he calculates his annual ISR:

  • •Gross Annual Salary: Q10,000 x 12 = Q120,000.00
  • •Less single deduction: - Q48,000.00
  • •Less annual labor IGSS (4.83% of Q120,000): - Q5,796.00
  • •Less VAT Invoice Deduction (assuming maximum presented): - Q12,000.00
  • •*Taxable Base Calculation:

Q120,000 - Q48,000 - Q5,796 - Q12,000 = Q54,204.00

  • •*Tax Application (First bracket, 5%):

Q54,204 x 5% = Q2,710.20 annually

To find out how much will be deducted each month by his employer, simply divide the annual total by 12:

Q2,710.20 / 12 = Q225.85 monthly.

Practical Tips to Optimize Your ISR Payment

1. Request invoices with your NIT: Don't miss the opportunity to deduct up to Q12,000 annually by submitting your VAT schedule through the SAT Virtual Agency before January 10 each year.

2. Review your projection with HR: Make sure your employer is using the correct figures for your income. If you get salary increases mid-year, the projection must be updated to avoid surprises with a large pending payment in December.

3. Plan your finances: Knowing your exact monthly withholding allows you to better budget your fixed expenses, save for emergencies, and avoid unnecessary debt.
